These Terms of Service ("Terms") govern your use of our website, www.creativefurniture.us (the "Website"), and your purchase of products from Creative Furniture Inc., a furniture wholesaler located at 388 US-22, Whitehouse Station, NJ 08889. By accessing or using our Website, placing an order, or engaging in any transactions with us, you agree to be bound by these Terms. 3. Pricing and Payment
3.1 Pricing: All prices are listed in U.S. dollars and are exclusive of taxes, shipping, and handling fees unless otherwise stated. We reserve the right to change prices at any time without notice, but the price at the time of your order confirmation will apply to your purchase.
3.2 Payment Terms: Payment is due at the time of order unless you have an approved credit account with us. We accept payment via major credit cards, wire transfers, and other methods as specified on the Website. For credit accounts, payment terms will be outlined in your credit agreement, typically net 30 days from the invoice date.
3.3 Taxes: You are responsible for any applicable sales, use, or other taxes associated with your order. If we are required to collect taxes, they will be added to your invoice.
3.4 Pricing Errors: In the event of a pricing error on the Website, we reserve the right to cancel the order and issue a full refund. We will notify you of the error and provide an opportunity to place a new order at the correct price.
4. Shipping and Delivery
4.1 Shipping: We ship to addresses within the 48 continental US states and select international destinations. Shipping costs and estimated delivery times will be provided at checkout. We are not responsible for delays caused by carriers, customs clearance, or other factors beyond our control.
4.2 Delivery: You are responsible for inspecting all deliveries upon receipt. Any visible damage or discrepancies must be reported to us within 48 hours of delivery by emailing info@creativefurniture.us or calling 732-248-0255. Failure to report issues within this timeframe may result in denial of claims.
4.3 Risk of Loss: Risk of loss and title for products pass to you upon delivery to the shipping carrier. We are not liable for any loss, damage, or theft after the product has been handed over to the carrier.
4.4 International Orders: For international orders, you are responsible for all customs duties, taxes, and fees. We are not responsible for delays or additional costs incurred during customs processing.
5. Returns and Refunds
5.1 Return Policy: Returns are accepted within 7 days of delivery for defective or damaged products only. To initiate a return, contact us at info@creativefurniture.us or 732-248-0255 to obtain a Return Merchandise Authorization (RMA) number. Returns without an RMA will not be accepted.
5.2 Condition of Returns: Returned products must be in their original condition, unused, and in their original packaging. You are responsible for return shipping costs unless the return is due to our error or a defective product.
5.3 Refunds: Refunds will be issued to the original payment method within 10 business days of receiving the returned product. We do not offer refunds for non-defective products, custom orders, or products marked as final sale.
5.4 Custom Orders: Custom or made-to-order products are non-returnable and non-refundable unless defective. Any defects must be reported within 48 hours of delivery.
6. Warranty
6.1 Limited Warranty: Creative Furniture Inc. provides a one-year limited warranty on all products against manufacturing defects, starting from the date of delivery. This warranty covers defects in materials and workmanship under normal use.
6.2 Warranty Exclusions: The warranty does not cover damage due to misuse, improper assembly, normal wear and tear, or modifications made by the customer.
6.3 Warranty Claims: To make a warranty claim, contact us at info@creativefurniture.us or 732-248-0255 with your order details and a description of the issue. We may require photos or return of the defective product for inspection.
6.4 Remedy: At our discretion, we will repair, replace, or refund the defective product. This warranty is your sole remedy, and we are not liable for any incidental or consequential damages.
7. Intellectual Property
7.1 Ownership: All content on the Website, including images, product descriptions, logos, and designs, is the property of Creative Furniture Inc. or its licensors and is protected by copyright, trademark, and other intellectual property laws.
